| Guiding
Principles In The Decisions Of Service Law |
 |
About the Book
The central Administrative Tribunal was constituted under
the Administrative Tribunal Act, 1985nwhich came in to force
from 1.11.1985. Since then more and more employees and employersmake
use of this judicial Forum for redressal of grievances and
to get speedy inexpensive and complete justice as this is
the Court of first instance for Services matters.
In many topics of service law, as there are no statutes to
govern the situation, one has necessarily to rely on case
law. This is why it is absolutely necessary to get familiarized
with the important cases decided by the Apex court and other
Court to be able to arrive at just solution in a given case.
The decisions of the tribunal being increasingly upheld by
the Higher courts only strengthens the Justice delivery system,
Towards
the above goal, the present book presents the decisions
of about one thousand important cases in service law and
general principles, skillfully analysed and annotated under
seven chapters with over one hundred distinct sub-headings
for facility of search. The seven chapters deal with the
Genral principles of service jusrisprudense, Law Applicable
to Recruitments and Appointments, incidence of service,
Disciplinary Proceedings and punishments, including in the
police force, final retrial benefits, and connect subjects
like contempt jurisdictioions .
Apart from the Central Government, there are now 45 other
organizations which have been notifieid under Section 14
(2) of the A.T act which come within the jurisdiction of
the tribunal. A new chapter II has been added on the interpretation
of the provisions of the Act, which govern the setting up,
functnioning and powers of tribunal... Memebres are appointed
to the tribunal have to learn and develop the specialized
branch of law so that disputes are settled. The litigant
himself being often an aggrieved officer can also delve
in to pages of this book , apart from the others users.
The law on the subject has been so arranged that it may
serve as a refrence book to bridge the gap between government,
other employers and employees and to enable them better
understand the subject to serve the ends of the juctice.
